General terms and conditions
The Services offered by TRAVEL TO CROATIA as defined below, can only be used by Clients who have first read these General Terms and Conditions and accepted them unconditionally by clicking on the appropriate box provided for the purpose. It is not possible to proceed with the booking process without this acceptance. Clients undertake to fulfil the obligations contained within these terms and conditions. The agreement between Clients and TRAVEL TO CROATIA comes into force as soon as TRAVEL TO CROATIA provides written confirmation of a booking to Clients by email.
Clients should save and/or print a copy of these terms and conditions for future reference when making a booking.
These General Terms and Conditions are governed by the laws of the Republic of Croatia. The Client agrees that the Croatian Courts shall have jurisdiction to hear and determine any dispute arising from the interpretation and/or arising here from.
The following definitions have the same meaning whether they are singular or plural.
‘Client’means a Client who books one or more Services offered on the Website.
‘TRAVEL TO CROATIA’registered tourist agency TRAVEL TO CROATIA, whose registered office is at Zagreb 10000, Novska 36, Croatia, owner Tomislav Tumpić.
‘TRAVEL TO CROATIA’is the name of the Website providing booking service.
‘General Terms and Conditions’means these general terms and conditions for booking and use, as amended from time to time.
‘Location’means Novalja and Zrce beach, Island of Pag, Republic of Croatia.
‘Travel Package’means a Service that generally includes standard accommodation, festival ticket, goodie bag and complimentary drinks.
‘Rules and Restrictions’means the terms and conditions applicable to the Suppliers with whom the Client has concluded a separate contract.
‘Service’means all services offered on the Website, such as accommodation service, festival tickets, Destination Services, insurance and package holidays.
‘Supplier’means a supplier of Services, such as car hire company, insurance provider or Destination Service supplier such as restaurants, clubs etc.
‘Website’means the means the www.traveltocroatia.com.hr website.
The General Terms and Conditions are a part of main contract between TRAVEL TO CROATIA and Clients who are booking Travel packages or accommodation services.
These General Terms and Conditions apply to offering and providing of the Services by TRAVEL TO CROATIA operates the Website which acts as an interface between the Client and the various Suppliers offering the Services.
These General Terms and Conditions are subject to the Suppliers’ Rules and Restrictions which are made available to the Client before any booking is completed and which the Client also accepts at the moment that a booking is actually placed. It is the Client’s responsibility to familiarise himself/herself with the Suppliers’ Rules and Restrictions.
The General Terms and Conditions can be changed by TRAVEL TO CROATIA at any time without prior notice, although such changes will not apply to bookings that have already been accepted by TRAVEL TO CROATIA It is therefore essential that the Client reads, saves and/or prints a copy of the General Terms and Conditions at the time the booking is placed, in order to be aware of the provisions in force.
All the arrangements offered by TRAVEL TO CROATIA, are primarily dedicated to university and college students and to youth in general. Once a Client orders a certain Travel package arrangement from TRAVEL TO CROATIA, by telephone or on-line via TRAVEL TO CROATIA Website, it is considered that he has accepted these General Terms and Conditions. The booking made by Client is obligatory whether the order is given orally over the phone or in writing on-line. Therefore it is only possible for a Client to cancel the booking in accordance with these General Terms and Conditions. The Client is responsible for all the costs and consequences, which may occur due to incorrect information he or she provided when making a booking.
Prices, Travel packages, Accommodation
The descriptions on the Website specify the Services included in the price for each Travel Package. Prices are shown in Kn (Croatian Kuna). TRAVEL TO CROATIA is NOT in the VAT (Value Added Tax) system and VAT is not applicable. All payments via Direct Bank Transfer will be effected in Kn. All payments via PayPal will be effected in Euro (according to the middle exchange rate by Croatian National Bank on the payment date). Prices in other currencies published on TRAVEL TO CROATIA Website are for information purposes only. TRAVEL TO CROATIA reserves the right to change the prices according to Croatian Civil Obligations Act (the changes take place due to changes in currency exchange rates, changes in transport tariffs, changes in fuel prices…). Should price changes occur, TRAVEL TO CROATIA has the responsibility of informing the Client no later than 20 days prior to the day of arrival. If the agreed price of the Travel Package arrangement rises more than 10%, it is the right of the Client to cancel his booking without any further cost; this must be done within 2 days following the receipt of the notice of the price change.
The Client should be aware that the local authorities in Croatia impose additional taxes (tourist tax), which has to be paid locally. The Client is exclusively responsible for paying such additional taxes.
Unless expressly stated otherwise, prices do not include insurance, transport, visa and any personal expenses (laundry, telephone, drinks, room service, tips, etc.), nor excursions or the use of facilities, nor any more general costs that are not expressly included in the confirmation of reservation.
If TRAVEL TO CROATIA becomes aware of or is notified of any fraud or illegal activity associated with the payment for the booking, the booking will be cancelled and the Client will be liable for all the expenses arising from such cancellation, without prejudice to any action that might be taken against him / her.
TRAVEL TO CROATIA does its utmost to provide photographs and illustrations that give the Client a depiction of the Services offered. The purpose of these photographs and illustrations is to show the Client the level of service and the degree of comfort, and they must not be considered to be making any representation that exceeds this purpose. Photos and description of services advertised at TRAVEL TO CROATIA portal are sample and actual appearance of services may vary from photos.
If the Client causes any damage to the transportation vechicle or TRAVEL TO CROATIA travel equipment, the Client is obligated to reimburse such damge.
TRAVEL TO CROATIA is not responsible for Clients using alcohol or drugs during the trip and is not responsible for any injuries happened on the trip organised by TRAVEL TO CROATIA.
TRAVEL TO CROATIA is not responsibe to wait and may proceed with the trip if the Client does not show up on agreed time at the Location.
TRAVEL TO CROATIA also advertises other activities available in Croatia such as clubbing offers, adrenaline activities, nature sightseeing and excursions, gyms, restaurants, food and drink. When offering and advertising such activities TRAVEL TO CROATIA operates the Website which acts as an interface between the Client and the various Suppliers offering the Services. TRAVEL TO CROATIA is not Supplier of such services and is not responsible for such services in any sense whatsoever.
Booking and payments
The Client is responsible for his / her activities on the Website (financially or otherwise), including the possible use of his / her user name and password. The Client guarantees that the information entered by him / her on the Website in relation to him / her and, if applicable, his / her travelling companions is accurate.
Any use of the Website that is fraudulent or is in conflict with these General Terms and Conditions shall be reason for refusing the Client access to the Services offered by TRAVEL TO CROATIA and the Suppliers or to the other functionalities of the Website.
The Client can book Travel/Tour package by telephone, email or online at www.traveltocroatia.com.hr. When executing booking TRAVEL TO CROATIA and the Client agree to a binding agreement, which includes all information regarding the Travel Package arrangements that the Client has chosen.
PayPal and Credit Card payment
All such payments are processed by PayPal. The card information remains in the domain of PayPal and TRAVEL TO CROATIA as the merchant does not have access to this information. When making an on-line payment by PayPal or Credit Card the Client is redirected to the PayPal website in the domain of the card processing.
Secure payment service executed through the PayPal card systems enable the Client to electronically sign every purchase he makes online. Thus owners of the credit or debit cards are offered the most secure online payment systems currently available on the market, regardless of the credit card they use. Payments are possible with any of the following credit cards: MasterCard, Visa, American Express and Discover Card.
Confirmation of a booking, which includes the essential elements such as the description of the Service(s) booked and the price, will be sent to the Client by e-mail. If the Client does not receive a confirmation e-mail within 24 hours of placing the booking, he / she should contact Client Services at [email protected].
It is expressly agreed that the data stored in the information systems of TRAVEL TO CROATIA and / or its Suppliers shall constitute proof with respect to the bookings made by the Client. Data stored in computers or electronic media are valid proof, and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.
Amendment and cancellation of booking by the Client
All requests for amendments and cancellation will be dealt by TRAVEL TO CROATIA and with the Suppliers concerned. The Client does not have an automatic right to cancel a booking unless the Supplier provides for this in the Rules and Restrictions.
In the event of cancellation or partial cancellation of a booking by the Client, compensation may be required from the Client to cover the costs and damages. In addition to this, charges may be imposed by the applicable Suppliers. Where a cancellation affects more than one person on the booking, any applicable cancellation charge will be applied in respect of each person on the booking. In some cases, compensation for cancellation payable to the applicable Suppliers can amount to the full value of travel booked, so that no reimbursement to the Client is made.
If the Client does not present himself / herself at the departure of the trip, no refund will be due to the Client.
Should the Client cancel the booking TRAVEL TO CROATIA reserves the right to claim from the Client all the costs of such cancellation. The amount of costs depends on the date on which the written booking cancellation was received. Unless otherwise stated in the booking arrangements, the following cancellation terms are to be considered as valid:
If a Client should choose to cancel his booking, cancellation policy is as follows:
Date / Cancellation fee:
- 20 days before the service date TRAVEL TO CROATIA refunds 100% of the price
- 10 days before the service date TRAVEL TO CROATIA refunds 70% of the price
- 5 days before the service date TRAVEL TO CROATIA refunds 50% of the price
- 3 days and later before the service date TRAVEL TO CROATIA there is no refund.
Failure to arrive at the check in will be treated as Client’s cancellation and full payment will be due, in accordance with cancellation policy.
If a Client misses his plane due to late arrival or departure of the bus for any reason, the Client will not be entitled to a refund of any kind. TRAVEL TO CROATIA cannot be held responsible for late arrivals due to traffic, accidents or weather conditions.
Replacement of Participant
A registered participant in a trip can be replaced by a third party if TRAVEL TO CROATIA is informed of this at least 15 days before the start of a trip. However, TRAVEL TO CROATIA can object to the change of traveller. If a replacement person enters into the contract, then the Client, together with that replacement person, are jointly and severally responsible for the cost of the trip and any additional costs arising from the inclusion of the third party and including any cost to TRAVEL TO CROATIA for making the change.
Cancellation and change by TRAVEL TO CROATIA
TRAVEL TO CROATIA will inform Clients immediately of changes or differences to their travel arrangements. Changes or differences to the travel arrangements that become necessary after the booking is done and are not brought about by TRAVEL TO CROATIA in bad faith are permitted insofar as the changes or differences are not significant and they do not affect the overall character of the trip booked. The same rights apply to the altered arrangements as applied in respect of the original arrangements.
Luggage, documents and personal belongings
TRAVEL TO CROATIA is not responsible for the theft or damage of the Client’s luggage or other personal belongings, valuables and documents that the Client carries with him or leaves in the provided accommodation.
Complaints based on implementation of the Service not being in accordance with the contract should be submitted within 15 days of the contractually-scheduled end of the Service. In that case, contact [email protected]. Complaints should be made in writing. The limitation period begins on the day on which the Service ended. A Client has to inform of all irregularities and deviations from the agreed. TRAVEL TO CROATIA will not consider complaints arrived after the said period of 15 days and oral complaints.
TRAVEL TO CROATIA is neither the organizer nor the holder of Papaya Club. All complaints regarding the Festival organization, the facilities or the venue as such must be done at the spot of Papaya Club.
All complaints regarding the Domestic Services must be done at the Location immediately.
Weather conditions are considered to be “force majeure” and are not subject of the responsibility of TRAVEL TO CROATIA and as such do not provide any right for a refund.
Shuttle Bus & Airport transfers departure times may change due to force majeure, heavy traffic and other extraordinary conditions. All complaints must be expressed on the spot to Suppliers. TRAVEL TO CROATIA cannot be held responsible for such Services.
The booking price does not include insurance and Client is therefore advised to take out insurance that covers the consequences of cancellation and additional policy that provides cover for risks such as the cost of repatriation in the event of an accident or illness, and insurance for cases of accident and illness during the trip and luggage insurance. When travelling abroad it is recommended to obtain health insurance with global coverage. TRAVEL TO CROATIA can provide insurance services upon Client’s request (health, accidents, cancellations, luggage…)
By acceptance of this Terms and Conditions, every Client gives TRAVEL TO CROATIA his or hers permission to use photographs and videos made during visit at the Location (the photographs and videos could include every Client) for promotional and commercial use. TRAVEL TO CROATIA does not take any responsibility for the behavior of other Clients and damages Clients might cause to each other during at the Location.
TRAVEL TO CROATIA does not take responsibility for errors in the promotional material (catalogues, leaflets and websites).
At TRAVEL TO CROATIA Website we are committed to protecting your privacy online. Your Private Information will never be disclosed to anyone and will be used for strictly business purposes only. Personal information stored on our Website by our customers will only be available to primary customer service representatives, system administrators, and accounting personnel. All orders placed through our site are handled through a third party payment gateway PayPal.
When you shop on our Website, we collect personal information from you such as your name, e-mail address, billing address, shipping address, telephone number, product selections or other payment information. We may also collect, or our third party ad server and content server will collect the URL you came from, IP address, domain types (e.g. .com or .org, etc.), your browser type, the country, state and telephone area code where your server is located, the pages of our Website that were viewed during any visit.
How we use your Information

We may however, disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to:
- conform to the edicts of the law;
- comply with the order of a competent judicial authority in any jurisdiction;

Except as expressly set out in these General Terms and Conditions, all the information contained in this Website is provided without any warranty (either express or implied) or implied term of any kind, including but not limited to any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose or non-infringement. All such implied terms and warranties are excluded. By accessing this Website, the Client agrees that TRAVEL TO CROATIA will not be liable for any direct, indirect or consequential loss arising from the use of the Website, any delay or inability to use the Website, or from the Client’s use of links from the Website. The exclusions and limitations contained in this clause apply only to the extent permitted by law.
